Sort of what I was saying. Having it and enforcing it are two different thingsI think it should still be applicable as you never know when that will change. However, I would expect that between friendly nations they would realise what is bogus and what isn't and waive immunity accordingly.
The whole idea of diplomatic immunity was to prevent ambassadors falling foul of local bylaws and customs.
So things like holding hands, drinking in public, being in debt, being gay etc which is illegal in some places, doesn't apply to diplomats.
Killing someone does fall under diplomatic immunity, but the host country normally waives the protection in these situations.
Here, they've closed ranks and smuggled her back to he USA, which is pretty bad.
Countries have found ways around this before though, Germany was sick of diplomats speeding and parking illegally, the individuals couldn't be touched, so the police impounded their cars, which doesn't come under the agreement.
So, the UK could have simply denied the airbase flight status, until she was turned over and impounded every car that left the base.
