If I sparked a lad out on video and it appeared on the front page of a national paper I'd be sacked, no ifs or buts. Regardless of police charges. Stokes is lucky he is employed at a level where people want to keep him in a job. If he was Joe public he would have been peddled.
can't really argue with that, though if there are mitigations it should be brought into play.

Are you famous? Cause if like me, your an absolute f***ing nobody, why would you appear on a national newspapers front page?

Furthermore, what do you do for work and who employs you? It's been mentioned, but sparking someone out matters not, in terms of employment law, if you aren't charged/convicted. I'm fairly certain that if a firm sacked you, without having been convicted, you'd be pretty much guaranteed to win at a tribunal.

If the the legal experts see it that he has used excessive force then he will more than likely be charged. The recent conversation on this thread has been what happens if the police/CPS decide to take no further action and what happens to Stokes then.
Whether you or me or anyone else think he has or has not committed an offence is irrelevant really.

I’m stunned you can’t see that there is an outcome between being charged and doing nothing wrong

I have not said he has not done anything wrong. In fact I have made no comment on what he has done, as I have said I have not even watched the video. I have made a comment on what happens if the Police take no further action. The comment I have made is if the decision is to take no further action then in the eyes of the law of the land the force he used was justified. If that does happen then the fact that you think he "sparked" the lad is irrelevant.

No conviction does not justify it man. It may not end up with a charge, but that doesn’t justify anything

Leave it for now? He either gets charged or he doesn't. If he does then nothing changes and he does not get near the Ashes tour. If he does not, then the ECB can start their disciplinary hearing with the fact that the police/CPS have decided he has not assaulted anyone or involved in a public order offence.

Not disagreeing with that, but its still the fact if he cleared by the police then his actions where justified during the alleged assault. Therefore they will have to decide what he did that the other players who where out with him that night did not do.

In fairness, his actions being justified aren't exactly what the police will be saying if they say no further action. It's simply that they and the CPS don't feel they'd get a conviction OR that both parties have agreed not to press charges.

I work for a bank call centre and even at our level you do "your responsibly" training and sign to say you did it. Its parts of the terms and conditions of your contract not to do anything that can effect the company image. I know of 3 cases, one where a lad was caught dealing drugs, another where one was caught punching someone and another where a lass d a page 3 shoot. None charged with anything illegal but all sacked. To say in the stoles case that no charge means clean slate is deluded.

Absolutely. But the ECB could also say he brought cricket in disrepute but also that his missing games is punishment enough. (I presume no one thinks that there's a possibility that Stokes will be sacked from England forever)

No chance, although in days gone by he most certainly would've been blackballed by the selectors. John Morris never got anywhere near the Test side after the Tiger Moth incident so we're not really talking about that long ago either.

I agree, his punishment should be in line with everyone else, in my line of work he would be sacked, as a cricketer he should be punished as per the ECB rules. What did jack Burnham get for a bit of coke, 28 days or something?
