Yeah my point isn’t about whether the rules were broken or not, they clearly were and Southampton should be punished.
My point is about how much boro were impacted. Should boro be rewarded and given a second chance of promotion. If they were monitored for not 5 minutes, they wouldn’t have been negatively impacted through knowledge of their plans. If they were watched over an extended period of time, they could have been negatively impacted and perhaps should be put through to the final.

As it should be, but not having those protections in place isn't mitigation for an offender.

Whether or not Boro gained an advantage is irrelevant.

Imagine an Olympic 100 metres semi-final:

A competitor makes a false start. Whether he was deliberately cheating to gain a head start, or whether he involuntarily twitched aand triggered the sensor it's counted as an infringement regardless.

After checking the technology, the runner is immediately disqualified and the other seven sprinters compete for a place in the final.

I know your point, but it is slightly different in that was very public and easy to prove. We do have to prove Southampton did it first before anything. And now, within the rules, they are entitled to so much time to prepare a defence, etc.

I don't blame them. But they can't complain about spying if they're happy to play the fixture and hedge their bets.

It’s open and shut that they’re guilty.

What’s not open and shut is the punishment because nothing is written into the rules about what the punishment will be.
