So that's means he should be a case getting built at this moment or am I missing something

Ifs and buts really. You can’t prosecute someone for attempted manslaughter and poor workmanship.

Fraud is probably the only real crime and then they’re probably not too bothered about prosecuting what is probably classed as a small (to them) fraud.
