Im not sure i agree. I think (and tbf im no legal expert) think it will very much influence the severity of the penalty dished out. Are they guilty? Almost certainly yes.

I think publicly visible training observed incorrectly will carry a different penalty to a covert filming operation taken place on private grounds using drones or whatever else.

Like with speeding, you get done at 80 is going to carry a different punishment to getting done at 180. And middlesbrough arguing that they were at a sporting disadvantage has to be weakened by the fact anyone from the general public could view that training.
 
Think of F1. A driver causes another to crash, or disobeys a rule, and goes on to win the race. They get a 5/10/20 second penalty, and it promotes the driver who came 2nd to victory.

The person who they actually wronged doesn’t benefit. It’s about punishing the perpetrator, not compensating someone.

If it’s proven that it’s been going on throughout the season, every team who lost out to Southampton (in terms of individual matches or through play-off qualification) & can prove Southampton cheated against themwill have a case against them and could seek compensation through the courts.
That why they will play the Final, then get relegated before they become a EPL Member. Too little time til the Final IMO, and its a simpler solution for the EFL.

Wrexham will be going all out if there’s any evidence at all it’s happened to them and be wanting massive compensation as well
There's no perfect solution. But Boro being put into a final is a more appropriate one than Southampton playing the final and, if they win, Hull going up instead of them.

At least Boro are one of the sides who've been wronged, directly, and they're the ones who caught them and have brought the issue to a head.

With Wrexham, they have a case but it's hard to do with permutations i.e. if Southampton didn't cheat and Wrexham got a result against them, who'd have known how that would have impacted other results etc.....

Boro's is just a cut and dried - "Southampton cheated, give them the game".

So, the lad is an intern but a key part of the first team operation? I think Middlesbrough are understandably a bit desperate. If he is an intern he is not a key part of the first team operation. It needs sorting ASAP. From what I can see Southampton are probably up there with the top two in terms of ability and a better team than Boro. Why they would need to do this is beyond me. I still doubt Southampton will be chucked out of the competition.

Hi is an intern and a key part of the team. Will Still was an unpaid intern at his first club in Belgium, he was head Coach the very next season

It doesn't matter if they sent the tea lady, they recorded training prior to a match - the ability or status within the organisation of the person actually doing it is surely immaterial?

Not sure how old this article is, and he's removed his linkedin profile now, but he was obviously an intern at some point during his time at uni. They've sent the young lad to do their dirty work, he should know its wrong but is probably naive and keen to impress, almost feel a bit sorry for him that his name and picture is out there when its going to be more senior people that were responsible for sending him

 
EFL rule 127 - "Prohibited Conduct - Observing Training Sessions" - specifically precludes clubs from seeking to gain access to opposing clubs' training session, stating that: 'Without prejudice to the requirements of Regulation 3.4 (that each Club shall behave towards each other Club with the utmost good faith), no Club shall directly or indirectly observe (or attempt to observe) another Club's training session in the period of 72 hours prior to any match scheduled to be played between those respective Clubs.'

Not sure its fits within the 72 hours? But if so they are going to be found guilty, theres no doubt about that.

This all now comes down to if the EFL have a published punishment range/boundary list to be applied to rule breaches or if its completely free to apply what it thinks is best.

Its going to end up being a shit show like the West Ham Tevez situation.

I think the best thing is a hefty fine and if a points deduction, its applied to the next season they are in EFL with them starting at -10 or something.

How can you say give Boro a 3-0 result on the one hand and not Wrexham who would have made the play offs with said 3 points at the expense of Hull?
It starts getting too complex, especially when you're treating two affected teams differently?
