Interview Under Caution

Any body ever been subject to one?

During a family dispute last week I (allegedly) shoved someone - they phoned the police.

This happened 11 days ago and I assumed they had thought the claim of assault was stupid as they never came to my house on the day despite it being 30 seconds around the corner from where the argument took place.

Officer came to my house yesterday while I was out and told person there he'd ring today to arrange time to come back and conduct interview. He also said I might be required to write a letter of apology to the 'victim'.

Any ideas? Obviously I've got a bag packed, ready to flee the country.

See you in 15 years.
.
only joking

The letter of apology option sounds like the plod saying "FFS, this sounds like fuck all and I don't want to write it up, but this idiot wants to complain" and hoping this will make it go away.

If writing the letter saves you a court appearance and everyone else the bother, maybe do that. If the person receiving the letter is the kind of f***ing prick to lord it over you for your apology, you'd need to word it very carefully so you're actually calling him a cunt in a way no one can take action about

It might criminally but you can still be sued civilly. The apology would fk him right up if he was just using it as appeasement

The relative whose house it kicked off in is in bad health and was hospitalized yesterday with chest pains. I'm minded to do anything just to make this go away for him.
However, the person making this claim is an absolute c**t who would hold it over me.
I've also got a big problem with admitting in any way I've been physical toward a woman, which I'd never be.
If it was just a shove in the heat of the moment, I can't see it standing up in court as an assault, get a solicitor though if it goes down that path. Most likely they've agreed with the police that they would accept a letter of apology.

Imagine going to the police complaining about being pushed over.
Wasn't even pushed over mate. She was trying to get up off the sofa to get in the face of someone and I put my hand on her shoulder to stop her getting up.
Absolutely mental.

It sounds as the officer has decided that you are guilty without a trial and has in fact told a third person that you are guilty. I'm no expert on the law but I reckon the case would be thrown out of court simply due to the officer's conduct.

Restorative approach i think its called.
Saves them a shit load of paperwork apparently.
This.
I've googled it - it's used rather than an official caution - basically when the plod think the case is a load of sh**e.
Worried about it opening the door to being sued by the c**t, though.

I'd tread carefully in case there's someone gunning for a charge. I certainly wouldn't be apologising or even admitting touching the woman.

I wouldn't say too much about it on here as there might be people close to the loop.

Report her for aggressive behaviour in that case. We can all play silly buggers.

If they want to interview you under caution ask for the duty solicitor before speaking with them. Ask for their copy of PACE if you want some light reading while you wait. That's if you were in the station.

If it's at home I'd be contacting a solicitor in advance. Just make sure they specialise in criminal law and not family or property and the like.

I might be wrong, but i think if the other party accepts the "apology", thats the end of it and cant take it any further.

Is the person accusing you related?
