Ali and Hale refused to press charges - that’s why Hales isn’t in bother. Add to that, his ‘crime’ doesn’t fall under the banner of affray.

Affray to me seems a bit of a witch hunt, nobody wanted to press any charges, but the police and CPS want their pound of flesh so have gone down the affray route.

I don't think that's fair. There'd be blue murder if they hadn't arrested and prosecuted him. Would have seen like favours for a celeb: you can hardly argue this isn't worthy of investigation. I mean, aye, one or two of us may have had a drunken scrap - but he broke his eye socket man. That's f***ing heavy.

Are you saying Hales inflicted the broken eye socket?

If so, I think that falls under GBH or ABH and as I understand it, they are only enforceable if the victim wishes to press charges.

Because that’s what the law allows. The judge quite clearly knows the law inside out and deemed that the prosecution case against him wasn’t worthy of gaining a conviction. To save people’s time, he made the call. Do you think you know better than the judge?

The judge has seen all of the evidence that the prosecution have against him and theres nowt anywhere near the threshold for a conviction. How is that a fiasco? It seems to me that some cricket fans cant see the wood for the trees.
 
Stokes was 'talking to God'
The CCTV shows Stokes, just before he leaves his failed attempt to get into Mbargo
“You were looking up, and talking down your nose at the doorman. You were angry, weren’t you?” asked the prosecutor.
“I think I might have been looking at the night sky,” said Stokes.

”Who were you talking to?”
I don’t know, God? said Stokes
“I’m sorry?” asked the prosecutor.
“I was talking to God.”

And I suppose if the court make you swear to tell the truth on a holy bible it shouldn’t be considered to be ludicrous or treated with derision by the prosecution if you reference talking to God.
 
For those not following it closely is it correct that the two gay guys supposedly abused aren’t being called by the defence?

Given that seems the basis of his entire defence, why are they not being called? Especially as Stokes has several times stated he can’t remember what the specific language was?

Obviously don’t speculate or guess. Is there anything concrete?
