He must be in breach of his contract, at the very least this condition:
  1. “The Manager shall observe and comply with the rules and regulations for the time being in force of any organisation or body the rules and regulations of which the Club is bound to observe including those of The Football Association and League and in particular he shall at all times act in accordance with the League’s Code of Conduct for Managers.
It's unclear how high this went up the chain but certainly the manager has admitted to it.

They can throw good money after bad trying to go through the Courts but it won’t turn the clock back or effect anyone else playing in their respective leagues.

Any outcome will be financial only. Very difficult for the Courts to accept they are better placed to make a decision than the EFL.

There is the argument that Soton have been denied the opportunity to contest a game that would result in income in excess of £200m should they have won.

This isn't done and dusted yet. Even if the game goes ahead, there is scope for legal action and could drag on for months/years.

Even the appeal could say OK it's harsh but still give a simple 3-0 awarding of the home game to Boro as that's the training for the game they spied on. It would be the same thing, Southampton being out of the playoffs. Same result but not as harsh a punishment.

If for example a team get caught during the season trying to cheat another team by spying then they forfeit the game 3-0 but they aren't kicked out of the division. The EFL obviously can't do that now and award a load of 3-0's, hence the 4 point deduction but will that get reduced also?

I highly doubt the appeal will be successful given all the details that have since come out.

Considering the punishment is more lenient with a guilty plea, what could it have been without the admission? Expulsion and a 20-point deduction?

Aye fair point, or the EFL dug even deeper and found out they've been doing it a lot longer.

Because to me i dont see how they went from doing it in December then all of a sudden just stopped for 5 months to then get back to doing it

If he watched over an extended period of time then a lot of information could have been gathered.
