12 year old girl groomed online could face charges for sending a topless photo to paedophile

Seems a bit bonkers, but maybe the plod are trying to get a message out to the effect that sending such material is in itself a crime, making the victims of grooming think twice about doing it in the first place. A bit of reverse psychology in action?
I was wondering something along those lines. I'm sure 12 year olds will have no idea it's a criminal offence, sadly.
 


A spokesman for the NCA it always "puts victim care and safeguarding of children and young persons first and foremost."

They added: “In this instance we understand the child sent an image of herself to another person. If a young person is found creating or sharing images, the police must record a crime, in line with Home Office Counting Rules, and investigate.

“They have discretion not to take formal action if it isn’t in the public interest to do so. Police are encouraged to take a common sense approach that does not criminalise children unnecessarily."

So she's not going to face charges then is she?

It's a ludicrous way to construct the law, which could easily mean some dumb shit does charge a vulnerable child with a crime at some point. It makes no sense because the whole reason it's a crime to approach a 12 year old in a sexual context is that they aren't equipped to make the right decision by themselves.

And setting up a law with government/civil service departments involved that depends on common sense is like setting it up to depend on Stephen Hawking's breakdancing skills

The dirty bastard wanting pictures of a 12 year old should get arrested aye but not the child.

If a woman sends you a naughty picture then is she breaking the law?

Creating and distributing pornography?
Or in the 12 year old's case underage "porn", which would be illegal.

The child should be re-educated, and probably not allowed a smart phone until they know how to safely use it.
Mainly for their own protection

Aye I wouldn't let my bairns have a smartphone till at least 16 and would make sure they are fully educated on dangers

Technically, they can. Age of criminal responsibility in England is 10. They would be unlikely to walk around in public and undress, so there ought to be a level of understanding that the action of doing it on camera is wrong. I'm very much playing devil's advocate here, and not suggesting that the CPS should ever do this but it's a technical possibility for a child aged 10 or over to be arrested and charged.

E.g your working away and your lass sends you a few pics. It's consensual between two adults and it's only getting sent to the person it was intended for.

It's not as if your going to show your pals the pictures if it's your lass

In an age where your data can be hacked and accessed I think it's pretty dangerous. Just look at "The Fappening" - just not at work.
It's not like old school picture messaging any more which was done more by text.

If she is under 16, then she is sending an indecent picture of a minor, so yes

But if you'd encouraged her to send it then you'd probably get done and they wouldn't charge her

No a woman hence why I said woman in my post you quoted.

Not minors in anyway I was talking about 2 consenting adults if sent each other is it counted as crime. Can't be surely not

This article is 2 years old but a 14 year old boy had a naked selfie sent on Snapchat recorded against him for the crime of making and distributing indecent images. The girl he sent it too passed it on too.

If anything with that she should be in bother for saving it and distributing it across the school. Not what you want coming up on a DBS check
