It's not an argument I'd want to put forward if I was in the dock on tax fraud charges mind:lol::lol::lol: It's not about whether it's a big amount to the professional, defrauding the public purse of £5m is a big issue. What are HMRC supposed to do, say 'hardly worth bothering' so anyone can then take the piss with their tax? It's a criminal act

Not just about the £5 million they've initially announced though. It's also about firing a warning to any other clubs thinking of going down the route of paying some wages via image rights instead. 43 players, 8 agents and 12 clubs were being investigated for this yet the only arrest in England I've heard of today is Charnley. I reckon he's proper fucked like.

COP9 is a procedure they can use an alternative to prosecution ; the figure of £75k quoted seems about right (by the way that's tax lost, not income undeclared). Under it, HMRC will waive the right to prosecution in return for a full disclosure by the taxpayer, plus payment of tax lost, penalties of up to 200% of tax lost, and interest on overdue tax. HMRC like this, because it gives them certainty.

That they haven't suggests that either the amounts allegedly involved here exceed limits where HMRC feel comfortable with using COP9, or that they feel that a prosecution is necessary in the public interest, or that it is linked with another criminal investigation which could be compromised by non-prosecution of the tax offence.

The implications are extremely serious; they must almost certainly be of the opinion that the evasion is so egregious that it can only properly be punished by the imposition of criminal sanctions, which probably means custodial sentences somewhere down the line. They must also be petty sure of the strength of their evidence if they're prepared to put it in front of a jury.


180 HMRC cops involved in the raids on high profile companies , I pretty much guarantee they

a) Have them absolutely bang to rights with shit loads of evidence

and

b) The intend to throw the book at them.

Such a high profile raid and failure to take significant action would be a PR disaster that would have every man and his dog thinking tax evasion was just part of the game.

The fuckers are going to be vilified and would assume Charnley and anyone else they can get are going to be doing the porridge.

My real concern though is that football corruption cannot be seen to go unpunished. I think a relegation and preferably two is the MINIMUM that must happen to both clubs to deter others from cheating. Tax fraud ias as bad as steroids in athletics imho :lol:
 
I reckon Charnley shat himself and said he'd spill the beans on Ashley's dealings for a reduced sentence.
