How what? How did they get his DNA? Presumably by collecting DNA samples voluntarily from every male who had access to the patient, and then investigating the hell out of anyone who refused consent (to potentially get a warrant to obtain the DNA). It's not that hard to get someone's DNA even without a warrant if you really want to.

the thing to remember (with your example) is that mental capacity is question/decision specific - you cant just say 'person has lost capacity' - each thing has to be treated (within reason) separately

ie, does this person have the capacity to manage finances, does this person have the capacity to determine where they want to live, does this person have capacity to decide do they want to be with their partner (and have sex), etc

Those things can change at the drop of a hat with dementia specifically. A person can be in a position to make sound decisions one minute and not the next with things getting worse as the disease progressed. Accepting the advances of a partner and then not remembering the consent

And I’m looking at it as a wife having dementia as I’m male. Turn that round to a husband having dementia and the wife wants a bit. Bloke seems up for it by being Aroused but not in a constant mental state to give consent
