Keeping Tenancy Deposit For Petty Reasons

I realised after posting that I was leaving myself open to all kinds of accusations. I'd have bet my last penny you'd be the first one to make them as well. :p

Me and a mate rented a flat in Brighton and had numerous issues with the water and heating. Tried everything to get him to put it right but the slimy bastard never did. When we moved out we withheld the last two month's rent, and let him keep the month deposit. We also threw a huge party and invited people to draw all over the walls, handing out permanent markers to people when they came in. The walls and doors were covered floor to ceiling. We also left all the rubbish from the party, bottles, cans , tab ends ground into the floor and all the taps left running. Sounds a bit harsh, but he deserved it. The bloke was a Grade A kernt. He's probably still looking for us and it was 20 years ago now. I would do the same again and I hope the stress killed him.

I took £500 off the previous tenant as the house stank of smoke.
He said he never Smoked in the house always in the garden. Aye reeto.
He appealed and they only let me keep £200 off him.
Cost me £600 for a deep clean, including carpets and curtains and some new paint where it had gone brown where he sat in the living room.
Some tenants are terrible, but most are good people but never look after a house like it's a home.
There's always two sides to the tale but the law is generally stacked in favour of the tenant IMO
 
Past caring at this point as I'm glad we are rid of our negligent landlords who refuse to fix mould, damp and mushrooms growing out of our ceiling.

However as an extra kick in the balls they've kept £150 of our deposit to pay for a cleaner to clean the house after sending us pictures of some dust on top of the cooker's hood and on top of the cupboards. It's pretty laughable to be honest and I'm genuinely just glad to be away from the twats tbh.

What other petty reasons have people on here been screwed out of deposits for?

I once touched up some walls in our house with paint that the landlord left for me. Last thing we did before we gave the keys back

Peter Heron then came back at us and said the paint used was not the same colour. Turns out the walls were all various shades of magnolia. Tried to keep the full £475 deposit but they only got to keep £150

I’d only moved fifteen doors along the street but they tried to claim the whole house needed redecorating, it was a little shit hole when we moved in and we were only there six months. The best bit was when the built in fridge went after three weeks and they claimed it wasn’t their responsibility because “white appliances” were not covered in the tenancy agreement. Whenever I contacted the landlord about any of these issues it was “it’s out of my hands” even when I offered to paint his walls for him after we had moved out.

Also had another landlord who was a bit of an arsehole. Gave me a bad reference on purpose - the new letting agent asked them “did they pay the rent on time?” And “would you recommend them as tenants”. He answered no to both because the first one he got his standing order through the day after the May bank holiday and the rent was due on the Sunday - no fault of my own, and the second he said “I would not recommend them as tenants because I would have liked them to stay for longer”. Also called us “grotty” because he came round one day and saw some of the bairns toys on the floor and the Mrs hadn’t done the dishes that day.

I f***ing despise the landlord culture with a passion, most of them are in the game to make money out of other people’s struggles. Going to be quite hilarious when the bubble bursts with all the negative equity and lack of private tenants. They will eat each other alive

He mentioned toys to us because there was 1 that bairn had stashed it seems that we missed and they mentioned that as an excuse too, it's almost like you could just pick it up and stick it in the bin.

It's the 22y old agents with pointy shoes that should be working in carphone warehouse that is the issue.

Nothing new here unfortunately. It's "The way these gunts are" unfortunately.

Not ALL of them. Just most of them.
 
On the opposite end of the scale...I once got my full deposit after my Mrs painted the kitchen pillar box red, the bathroom navy, and left an iron shaped burn in the carpet.

No f***ing clue how that happened. :lol:
 
I heard of one person who had a tenancy deposit put into the TDS but the letting agent set the bond at half price. However they got the full bond back and bagged an extra £300. Lucky bastards.
 
I’ve rented all over Sunderland and a couple of places in Heaton when I was a student and only ever had one landlord try to keep a hold of the deposit. Was my first one, claimed the outside windows weren’t cleaned so tried to keep it. Think he also claimed dust on the window sills and other things that were trivial and untrue. There were 5 of us in there on separate contracts. So that’s roughly £1500 when it would cost max a tenner for a window cleaner to come round.

Luckily he’d put it in a deposit scheme so when we challenged it we all got it back.

Bloke I rented off in Pallion didn’t want a deposit, just said give me the first months rent and you can move in. Was cheap and near work and he’d just done it all out so we did.

Worked out through his stories that he was up to his eyes in debt and really needed a tenant in there. Did his best with some of the issues, like the paint peeling off the bathroom wall, boiler going off constantly (was a converted house and the boiler for all 3 ‘flats’ was next door) but he was just bodging it really. Our neighbours were also both recreational drug users and up to their eyes in trouble. Coppers round every other week, people trying to boot the door in. Final straw was we eventually found rats were getting into the kitchen cupboards somehow.

Go past there sometimes now and the place is boarded up apart from the upstairs bit. Feel sorry for the landlord as he was just out of his depth and could tell he meant well.
 
At Uni our landlord was a mate of my friends dad, we had a look and it was a tip, but he redecorated (cheaply - I would have too). Anyway he takes us on a tour to show off what's been done. We didn't leave a deposit but we paid for new carpets (we got a deal by knowing a carpet fitter). Anyway he's taking us on a tour "Aye lads I'd put a dart board here", "Could get a pool table there", "I've installed a glass shower door in case you want to buck in there" etc etc, with his closing line being "Just do what ya want to it lads you're only students once". Anyway when we came to move out he booted right off because the carpets were a state, we paid for them the cheeky twat. Although he was trying to get stuck in to milf next door and she hated us, she'd boot off because we made noise carrying shopping up the stairs late at night, or we had music on in the shower at 8am. I'm sure we were a relative nightmare being students, but whenever her kid was at his dads, she'd be throwing parties and blasting music so...

Also reminds me that when moving out we had some scruffy looking second hand furniture blokes come to pick stuff up, smoked the whole time and traipsed mud throughout the flat. They took all sorts of shite, a broken sofa bed, knackered old wardrobe, but wouldn't take a pretty much brand new IKEA wardrobe because it was "missing a door". It didn't even come with a door ffs.

I'd have to agree in most cases (I've found out the hard way on a few).
But the deposit scheme is mostly fait to both parties. All it takes is a bit of due diligence on check in by taking plenty pictures and have everything documented.
 
Second year of Uni, one of my house “mates” left some kippers behind the radiators in the lounge and in his bedroom and turned the heating on. Needless to say we lost our deposit.

The daft twat. He was Durham Mag too.
 
I have enquired with them as to how our deposit was protected, I guess they'll shit themselves and google the answer, can I ask them for proof?
Not only that, you get an email when it’s first put in and an email when it’s being returned. If you haven’t, they aren’t holding it properly, and by default you’re entitled to 3x the deposit figure.

They also have to have electrical testing certs, EPC and gas safety certificate, I’d they haven’t provided a copy of these to you and kept them up to date, they are in breach of their legal requirements.
