The driving ban (minimum of 12 months) is mandatory for drink driving convictions. The magistrates have no power to waive it. (Road Traffic Offenders Act 1988)

They can adjust the fine and come out of their sentencing guidelines on the length of ban once above 12 months based on mitigating circumstances of the case, but if plead/found guilty the defendant must be banned for at least 12 months.
Having read it though, she hadn’t got in the car, not sure if that changes things.

It’s a weird one this. Other reports said she pleaded guilty to drunk in charge as she was stopped in the drivers seat; as she’s admitted to planning on driving I’m not sure why this wasn’t attempting to drive.

A quick look through the sentencing guidelines handbook and it says ‘must and endorse and may disqualify. If no disqualification, impose 10 points’.

Even more bizarre is that she’s represented herself and this hasn’t been a drink drive specialist solicitor who got her off.
