They do look very much like the same thing mind. I think if it just had a marzipan face it would be ok, but it's the white chocolate face and feet that make it look like the M&S one.
 
Probably made in same factory’s too. I visit a fair few of them where products are made for all supermarket chains. Same manufacturing process and tooling etc, often just a slightly different ingredient mix.
This was highlighted to me by a sainsbury's manager a few year ago when I asked why they had no ginger nuts in stock - not of any brand!

The factory in Cumbria that makes ginger nuts for most companies had flooded in a storm so there was a mass shortage.

Not sure how true it was mind.
 
A lot of M&S and Aldi products do come from the same factory. Also, I'm convinced that M&S and Co-op have the same producer for one of their yoghurt ranges.
I remember a show on tv not so long ago where the yoghurt factory said something like "we made all the yoghurt for the uk market"
Williams Bros aren't poor in my opinion.
Their blood orange IPA and peach IPA are well nice. Joker IPA is quality too.
