Happens every week in almost every town centre. That doesnt make it right, but they are probably trying to make an example of him to stop others doing the same.

A fine, community service and an apology is what i think he should have. Im sure he'll have learned from it already, missing the Ashes etc.
Aye. Sometimes you think the biggest punishment is not what that courts hand out (sometimes, ie a slap on the wrist) but the effect it has on the person's life ….. the worry of the whole thing, possible loss of job, cost of defence, effect on family etc. ------ whatever, if you want a good life stay away from stuff like that.

Whether he is a good bloke or not is by the by, the courts should be impartial (I think we’re agreeing)

yep, punishment should be about making the person not want to do it again. Him missing out on cricket is more of a punishment than a fine because of the money he has.

And it'll carry on happening, week in, week out, in almost every other town/city centre, regardless of what happens to Stokes.

The last thing two pissed-up knackersacks squaring up to each other will be thinking about is, "better not do this. Remember what happened to Stokesy!"

Notice the counsel for the other two has started out by saying that all three are men of promise, trying to equate their prospects with that of Stokes.

Apologise to who? The arseholes hurling hate speech, armed with a bottle, on trial for the same charge?

Stokes deserves to get off FOC due to aggravating circumstances. It would be wrong to send the message you can't stand up to these people.

The video has nothing to do with other people not being punished for similar crimes. That's not the point I was making.

I reiterate - had it been a layman it wouldn't have gone anywhere near a court.
Agreed. More people should go to court for this type of behaviour.

An apology in general for his actions, i think would be appropriate. He let a lot of people down, apologizing would at least make it look like he is remorseful of what he has done.

Don't understand this, that is what the bouncer is saying however, the 2 lads did a paper interview IIRC and said Stokes and Hales were having crack with them and even went for a few drinks with them. If it was done, it appears to have been done in jest and taken the same way

Well this is the prosecution and there take will have a very different slant. I would imagine that Stokes would be calling the two lads as witnesses to contradict the word of the bouncer with their version of events if the reality was the same as published in the papers.

Im sceptical and open minded

I don't claim to know what the motivation was, but if you give someone a kicking the way Stokes did, you open yourself up to prosecution no matter who you are. If I was the best all rounder in the world I would be a million miles away from situations like that.

Well, this.

This whole trial is a bit of a joke. I think Stokes is only filing not guilty because the other toe-rags have and he wants his story out. Legally, he's guilty - the footage proves it.

All the other stuff are circumstances that can lessen or increase his sentence. But he brayed the lads and went beyond self-defence - that much, surely, is crystal clear.

Braying people is illegal, even if they 'deserved' it in the court of public opinion and/or morality. As I've said one thousand times over.

Aye, well, I mean, on one hand you have the British press and on the other a criminal defence lawyer.

Could you find two less trustworthy sources?
