Employment law

Meet them in the middle and say you'll leave after 1 if they pay you for 2. Depends on what you so but some companies won't want you there to fuck anything up on purpose, but they can legally make you work it on another section

Bit harsh 😂 nailed on you work in management mate 😂
I do work in management
Why would you not be at work in your 3 months notice period ?

Like they should ,you still work there
They put me on gardening leave as I'm going to a competitor
It sounds like you’ve got a great offer. A month off paid, new job lined up after.

What more do you want?
Issue is that due to the days I get paid in each job, i'll have to go 5, nearly 6 weeks without pay. My angle is just getting enough money so I don't have to eat into savings.
I bet he wants his holiday pay on top of his 3 month pay to lay at home and watch Homes Under The Hammer
And my bonus

Stick to the 3 month notice period and put aside a few quid to cover the upcoming difference in pay dates.

I missed that detail like. They could just be trying to bluff you saying they'll get you to do something.

Edit - re read the op, your suggestion seems ok to me about being paid up for 6 weeks. If they want you to leave early then they can pay. Doesn't really suit them to pay you to stay at home for 3 months but doesn't suit you to work for 3 months either. Not often you get the chance to have a month off work to travel or do as you please fully paid

I thought you said they're finding stuff for you to do ?

If they don't want you in they'll have to pay you
They can't change a mutually agreed notice period
The ultimatum they gave me was if the new company won't take me early they will find me stuff to do, if I agree to leave early they will give me gardening leave.

So the issue is that you have to wait a couple of weeks because your monthly/period pay date in lieu is a couple of weeks behind your current employer? But when they pay you, you’ll get 6 weeks pay. Or maybe you’ll get 2 weeks pay on their regular payroll day?

And that’s why you want your current employer to pay you for 2 months for doing nowt. And now i understand they are - coz they’ve offered gardening leave coz you’re going to a competitor?

And you’re in management you say?

Depends if you're bothered about burning bridges. You could just refuse to change your resignation or notice period and see what they do.

Worst case you can always go back to them and say you'll leave after 2
I believe it was a bluff, and as I said the new company will take me early, as per my original post, that is what I was going to do, ask for 6 weeks as I've done what they asked with not much in return

Edited my post just now. Personally I'd save yourself the stress of potentially having the long drawn out notice and leave on bad terms. Ask them for 6 weeks which is reasonable imo but take the 4 if not.

Current company pays mid month, I'll get 3 weeks pay, all of my bills then come out between the 15th and the 25th. When I join the new company I will miss their cutoff for PAYE, so I need to wait until the 25th March for pay, therefore I need to pay 2 months bills with one pay packet.

Yes I understand the concept. I’ve been in that position a couple of times myself. I know one or two people who asked for a mid month advance. I never did.

I believe the technical expression for this situation is ‘life’.

😉

Pretty standard to get gardening leave if you're going to a competitor.

In my job you're not allowed back to your desk after you resign. Security come down to reception with a box full of whatever is on your desk.
Depends what role you do though doesn't it as to whether it's a risk having you around

I know but it doesn't even sound like he's been offered
He's said they'll let him leave early to start new job or keep him busy during his notice
Neither which is gardening leave

I've just quit my job, I had a 3 month notice period but the company asked if I could leave after 1 month. My new company is happy tp take me early but I really wanted a 3 month paid holiday.

I'm assuming (since I'm not a football manager) that this means they only want to pay me until my contract terminates in 1 month. However they did not say this, they just said there's no way the company want me on gardening leave for 3 months.

I've agreed to leave early & they want me to update my resignation letter, do i just simply update with a new date, or chuck in a statement saying that the company wanted to do this, not me since I'm leaving on their terms these should at least pay me 6 weeks (half)? Or am I just fighting a losing battle?
Do you get full pay if your sick ?

Pretty much the same for me. I handed my notice in back last March and they didn’t even let me finish my shift. I was offered another job in the company 3 months later and come back with no hard feelings from either side

If you think they're bluffing, call it.

Just move your direct debits, or pay with savings and replenish once you're paid.

I'd call the bluff myself. If you have to work it you have to work it but they are taking a risk if you are going to a competitor.
They put the three months noticed period in and they can pay up if they want you out early.
I'd be happy to settle for 6/7 weeks pay in a situation like that though.

WTF, which employer is going to pay you two but only make you work one. Manager or not I’d be telling him to give his head a shake.

Leave after one and get paid for one or leave after three and get paid for three.
