Bit daft not paying it tbh, best advice is to pay it and then get a refund when you win.

You probably will win, if as you say you've been using it and paying and can prove the machines were knackered and you paid ASAP.
Not sure about with private companies. But when it comes to Local Authority parking fines you can't pay and appeal. As soon as you pay you accept the fine.
 


First of all, apologies for the long post but, has anyone ahd any dealings with these scumbags?

Last year, I parked my car on that awful bit of wasteland on Cowan Terrace at 8.20am (opposite Park Lane Metro) to go to work. As I did every day for 2 years, I tried to use the Phone and Pay app. On this occasion, it wasn't working so, I rang the number, only to be informed the systems were down and that I had to try again later. I went to work, tried a couple of times before eventually being able to pay at 12.20pm. I paid for 24 hours but also removed my car as was going to another site for the rest of the day and was informed by the woman on the ohone I would likely have been issued an automated letter, to which I told her I wouldn't be paying anything more.

Anyway, this went on for over a year with increasing amounts and threats of Court and Bailiff action until, a month ago, I reveived a CCJ from.Northampton Counth Court demanding £300. I immediately rang the court and was informed I cpuld challenge it for the fee of £275 which I refused to pay as had commited no offence. I have written to both them and CEL, which replied with a yet more threatening letter, claiming they could put a charge on my home etc.

Has anyone else had dealings like this? I've written to my local MP who has written letters to CEL and is awaiting a response, I've also written again to them, claiming they actually owe me money as I paid for far more than I stayed (I also paid for 24 hours the following morning whilst still in that 24 hour period) but, it looks like I'm landed with a CCJ for 6 years and Bailiffs on their way, imminently.

Its an utter disgrace when I did absolutely nothing wrong and paid in good faith, as soon as I was able via their system. I'm certainly not taking this lying down and would rather go to jail than pay them another penny.
Also, since I last wrote to them, saying my MP was on the case, my payment history, including that transaction on their app has suddenly disappeared (I'm sure that's pure coincidence).

Any advice from the resident SMB Legal Eagles?

Appeal the CCJ even it means paying a fee. Smalls claims action will recover any costs.Contact the CEL asking for a copy of the court proceedings letter with proof of posting.
Write a letter to CEL requesting information on any faults or outages for the app on the day, keep a copy.
Phone records from the day in question showing your reasonable attempts to pay.

Cheers mate. I've written requesting their phone records as they claimed their "lines were working perfectly that day" which wasn't the issue, it was the payment system. They also claimed they'd "carefully" examined all transactions before and after I'd arrived, I've requested these also. I've also requested a full transcript of the coversations I had with the lady answering their phone.

If they're dragging their feet over that latter and you haven't already, make a formal data subject access request.

These fines are usually invoices, dressed up to look like fines.

Challenge the invoice as you paid for a service consumed. They should have to prove that you cost them the invoiced amount for a service.
 
go on pepipoo.com plenty advice on there. I took them to court about 10 years ago after several letters from them. I compiled a case and letter (templates from pepipoo) etc. right up for it i was snd they didnt turn up at sunderland. Case thrown out, i tried to do them for lost working time but didnt get far. They are kernts. Dont pay them, just get good advice. Oh and i think they threaten you with all sorts but am sure they cant actually fine you any more than £40 or somet. Good luck

True. And they nearly always anonymously lie about the circumstances, tell you there is nothing in the legislation about your specific circumstances and tell you that you have no further right to appeal.
 
Bunch of arseholes. Ive got a charge notice now from parkingeye. Easily defendable at this stage, I will not be paying. Yours appears a little more advanced but with good evidence gathered, as outlined by other posters, and getting it back in a court, it's nothing a reasonable judge won't chuck straight out. They can see straight through these pricks.

Cheers mate. If I'd refused or even just forgotten to pay then fair enough but how can you pay for something when the company's system's are down and the person even says "you may receive an automated letter" - knowing it is nonsense, when its fixed and you actually pay?

Also, how do they send out an automated letter when you haven't even left the car park? I could have been there for a fornight for all they know?
