Only if there were aggravating factors at play. If it was a straight up bucking scenario neither one would be prosecuted as it simply isn’t in the public interest, even though they’ve both broken the law.

I don't think keeping it at the police's discretion is ideal. If they decide they don't like you, they can pursue it.

Argh right, you'd like to see a specific age related law. Would be ideal but I'd imagine it would cause a fair bit of unwanted bickering & can of worms in Parliament so will never likely be raised.
