Any property probate experts offer some advice?

My dad passed away 18 months ago and his estate has taken ages to progress - mainly due to his bitch of a second wife who is contesting everything!

She was left 50% of his house, with the remaining 50% split between my sister, me and his wife (so me and my sister own a third) The wife has offered to buy our share - at a rate below market value we don't agree on.

We don't want to just give it away, so could we call her bluff and insist it's put onto the market? Also are we entitled to start charging her rent in the meantime for our third - and can we back-date this to when he died 18 months ago?

We just want this resolved asap, but want what is fair - so any help appreciated? Cheers
 
Tell her to get 2 estate agents valuations and rental market valuations and you get 2 as well.
Meet in the middle or average of the 4 estimates.

If she disagrees on the buy out price start charging her the average rent price,( which she will know is right as she will have got 2 estimates off her estate agents.

If she refuses both options move into the house and with 2 inch masking tape split the house in half( like the steptoe and son episode).

We have a similar situation - but I find it surprising the will isn't written in a way to protect the survivor, if your Dad and his wife lived together.

Probably not what you want to hear.

It was 're-written' around the time he was contracting dementia, but we can't prove this as he signed it.
