Employer buying back employees unused holidays

Always been able to buy and sell holidays.

selling them has never been great as you get taxed on them. So never as good as you expected. Buying came as source.

I would take the time off. Been a wage slave won’t be remembered in 6 weeks when you are gone.

I see what you mean. Having reread that post I would agree. I read it that someone is on furlough and took some holiday and furlough was claimed. Which is fine imho.

Yeah, was topped up to 100%. I don’t really understand the extra week furlough on top? What does that mean?
I'm unsure of your situation, but this is for those on flexi furlough. If you're on permanent furlough it doesn't matter as you are getting furlough days anyway
If you're working every day, the company can't just put you on furlough for your holiday.
If you took a days holiday, they would also have to give you a days furlough too.

This is so companies can't just have people in working as normal and then claim gvt handouts in furlough purely for their leave. Its to prove that their is a need to have them on furlough, so the company has to give equivalent furlough days off on top of the furlough leave that you took.

Ie you work all of January, February you take a weeks leave, the company can't just put you on furlough for that weeks leave. They would also have to give you another furlough week off. (But you just take the 1 week as annual leave, the other week is gvt furlough)
Not really relevant but I'm moving government departments next month I think. My current department have told me I need to use up all of my annual leave and flexi before I do (15 days leave accrued and 1 day flexi).

Is this unfair or allowed? I was hoping to get a git big bumper wage off them when I leave.
Depends on the company and why you have so much leave accrued.
you should just be able to take leave over in line with your company policy (or ask to take over a greater number due to the pandemic and out in place a reasonable suggestion for getting rid of your leave- could you be taking some days leave now?)
If you have been sick you will have more options as its not your fault you have been unable to take leave
If its because you have been furloughed or haven't taken leave then doubt it. You should have taken leave when on furlough (or the company could/should have made you take leave - if you're on furlough for months , they should have been making you take pro rata leave or you should have been doing this anyway- and getting paid 100% for that leave). If they didn't want you to take leave as didn't want to pay 100% its a different story and you may have a claim if you can prove they forced you to not take leave.

If you've been on weeks/months of furlough , and youre now wanting leave bought from you for days holiday which you refused to take, or didn't want to take as you had been furloughed, then quite rightly there is little you can do.

Due to lockdown the past 12 months employees have a fair bit unused holidays (including myself)

Director has emailed all to say company will buy this holiday off staff , to stop build up , at a £ rate of 75% , no discussion on carrying forward etc

Does that sound fair practice ? wasn't sure if was missing a trick :)
Take the money and use it as spending money on holiday - ah hang on a minute ......

Are you changing employers? Or just a departmental move within the same organisation? If the latter, then your leave & flexi should just carry forward into new job. If former then it's not unfair

For example, atm im not needed at work as much
I usually work 20 days a month. If I took 10 days leave and was rostered the other 10 days at work, then work could only take 5 of these as my annual holiday, and they would have to give me the other 5 as furlough. Or they could take all 10 as my annual leave and furlough me for these 10 days but then they would need to give me 10 more days furlough

I’m surprised at this mind as my company does everything by the book, both legally and with their employees. I get the logic of what you’re explaining. It doesn’t really bother me how I’m paid TBF.

1 day holiday = 1 day pay.

No, I had about 3 months in LD1 and have small bits on flexible.

But I wouldn’t say it’s a 1 for 1 scenario.
 
75% BEFORE you get taxed at 20% IT+10 NI%
So say you earn £100 a day, they'll put £75 in your wages, then you lose 30% of that - end up with £52.50

Not so great, now?
 
Happened to a mate of mine not long ago. They wouldn't pay up and the OGD wouldn't let him bring them, so was forced to take a fortnight off before shifting.

Not that I'm planning on doing it, but I wonder what would happen if an individual went on the sick for 3 weeks before they joined the new department. The old dept would surely have no choice but to pay them?
