Small Claims



I'm involved with a club, someone owed us (about £150), tried the small claims online service (£35 I think). They do no chasing other than send letters, it is a satisfactory way of bolloxing up the next 6 years of a twat's life however, and they must pay you the judgement debt + costs for you to treat it as "satisfied".
 
Going through it at the moment. I fitted a kitchen but some of the kitchen units and worktops arrived damaged. I got blamed for the damage even though I took photo's of the damaged units still in their protective wrappings. The arguments dragged on for over 2 months until I finally told the company I was subcontracting from to stick their work up their arses and left. They then kept my last weeks wages of about £1,300 plus the £840 for the kitchen. I took them to the small claims court and we agreed to go to arbitration, the SCC decided arbitration wouldn't work so I had to proceed and make a claim. The other party didn't fill in their paperwork so were timed out and I won the case …… or so I thought. The other party claimed a secretary had failed to email the completed forms so a judge decided they could defend them selves after all and we go to court in February. So all in all it will have taken 2 years to come to court and it is still 50/50 whether I win or not

This for me with a gardener, 870 quid, turned up once, made a start, never came back. Got someone else to do it in the end, not a big amount of money but didnt want him getting away with it. He’s not even contesting and the ccj awarded, so he’s got all the hassle now.

You could have applied for a warrant of control.
 
Yes. I've used it for tenants who have pissed about not paying rent. Getting a judgement against them using the small claims track is relatively easy so long as you fill the forms in correctly. Getting money out of the bastards once you have the judgement is a pain in the arse.

First one caved in as soon as he got the Recorded Delivery letter saying pay up or we lodge it with the court.

Second one caved in when court papers were served.

If you have a cast iron case it costs nowt.
