twats

a few years ago i had a pile of debt but resisted the temptation to stick my head in the sand and take the bankruptcy route...so i arranged for regular seperate monthly payments to all creditors via direct debit as i was now back in work..

Every time a debt was cleared the particular direct debit would stop, so when the regular payment to the council stopped i just took it as another creditor cleared.

eighteen months later and apparently debt free i get a letter from the council saying i owe nearly 3 grand and if its not paid in 4 weeks they are pushing for bankruptcy. i phoned to ask wtf was going on and they said 18 months ago i cancelled their direct debit and now they want it all cleared

i said i didnt cancel it (which my bank confirmed) and why did they wait 18 months, why not tell me after after one, two, three missed payments.

citizens advice phoned on my behalf to offer 150 a month to resume and clear the debt, which they accepted.

but..they got back in touch with the CAB to say they just found out im a homeowner and would rather push for bankruptcy and use the funds to clear the debt

am i fucked? seriously pissed off with the fuckers

Surely if you didn't cancel it, it's their cock-up. I don't see what you could have done to prevent this from happening, they have well and truly fucked you over, 18 months and then they tell you.
When you asked why hadn't they contacted you earlier, what did they say?

I'm not certain but I don't think they can force you into bankcruptcy over a few grand, it's your decision ultimately, although I could be wrong.

I'm not certain but I don't think they can force you into bankcruptcy over a few grand, it's your decision ultimately, although I could be wrong.

they said even if it was their fault it was my responsibility to know how much i owed

Apologies, just scanned the post. Surely your bank can tell you who cancelled or stopped the direct debit ?

Try and argue with them and ask the CAB with the point that it is totally unreasonable to ask for such large amount in a small amount of time
