    hey all.

    i sold an xbox 360 game 3 days ago for £35 using buy it now and the guy still hasnt payed. i have tried to contact him 3 times and sent 2 invoices for his purchase but he still hasnt responded. i had a look at his profile and they have no feedback apart from 1 transaction 8 months ago. i think its pretty clear that he no longer wants the game but after reading the T&C's on ebay apparently i dont think im allowed to relist the item until 4 days have past and then ebay will try to contact him themselves. at which point he has i think another 3 days to respond.

    now, the thing is im not being messed about and just want to relist the item again and cancel this guys bid. but i dont think im allowed to even tho its my item and he has broke my conditions of the sale. i clearly state payment within 24 hours.

    can anyone who knows about ebay rules tell me what i can do to get round this and just sell my game to someone else.

    I think you get 7 or 10 days to pay for an item even if it is on a buy it now. All that does is 'reserve' the item until you pay for it so nobody else can get it. Even those sellers who say immediate payment required can't moan if someone doesn'y pay for a couple of days. I have bought things myself and not paid for a few days if I didn't have enough cash until payday. At the end of the day if he still doesn't pay lodge a dispute and you will get your listing fee back. You have not lost anything, you still have the item and you can relist it. You could also sell 'another one of the same thing' right now and just refund the guy if and when he does pay.

    ha ha after my latest invoice i sent about an hour ago i have re checked his ebay profile and he has closed his account. says he is no longer a member. now what confuses me is that according to ebay rules i still cant open a case against him untill day 4. unreal.

    suppose i will just relist and if he then pays i will refund and tell him whrere to go.

    I'm sure I watched on the news a couple of years back and a police officer who deals with crime on ebay, said all a winning bid does is exactly that wins you the bid. At no stage do you have to complete a transaction if you dont want to.

    Bit like going to a shop, picking the box up, getting to the till and then turning round again without buying the product.

    It could be possible this bloke had 2 accounts (or more) and was listing the same item. Getting you out the way until his was sold.

    as the guy has closed his account you can open the case and then close it straight away and you will be able to get your final value fee back and be able to relist straight away.
