    steady

    my entitlement for ESA has been pulled, due to me not attending a work capability assessment..no letter or phone call received, to advice me and then not given a new appointment.basically, they're saying i've had a letter (although it's not recorded delivery so have no proof i've received it) and i know for a fact that i haven't had it..

    i'm in hospital for a knee replacement on friday and am going to appeal their decision..as such, i'm not going to get any benefits for the foreseeable future and i'd like to be able to eat, while i'm trying to get over the surgery

    any serious advice from those who may work in the benefits / citizens advice type areas, as to what i could do?

    Ask for a reconsideration in writing, ask for proof you have received their letter, let them know you're more than willing to attend if you give you an appointment over the phone.

    thanks for that..spoke to someone at ATOS yesterday and he said that it was practically unheard of to stop someone's benefit after 1 missed appointment..said i'd be happy to go in for an assessement any time from next week but was advised i'd now be at the back of the queue..

    i've requested the appeal paperwork

    Just appeal marra it's almost certain that you'll win it.
    and go for a crisis loan in the interim so you'll be able to eat.

    it's laughable....

    like i said, i've never had a letter to advise me of an appointment..they've no proof that i received the letter, just that it was posted..why on earth i wouldn't attend when i've evidence that i'm undergoing this op..this would have been the perfect time to go for an assessment
