Southsea landlady takes her football fight to Euro court

    Published Date: 06 October 2010
A Southsea landlady in a court battle over the right to screen live football matches will have to wait until March to hear the verdict.
Karen Murphy, of the Red White and Blue pub, Fawcett Road, is taking on the Premier League in the European Court of Justice in Luxembourg.

The Premier League says the landlady is breaching copyright law by screening matches through an imported Greek TV system rather than Sky, which owns rights to Premier League matches.

The Premier League argues that the future of one of the UK's biggest and highest-profile exports - watched in 211 countries and worth £1.4bn - is at stake if the landlady wins her case.

But her lawyers say banning her from doing so contravenes a European treaty that guarantees free trade between member states.

She was originally acquitted because it was found she had not acted dishonestly as the system was recommended by her then brewery but, when taken to court for a second time, she was fined £8,000.

Opening arguments were heard yesterday, with the legal opinion of the advocate general due to follow on January 13 and final guidance due in March.

Verdict on Premier League v Karen Murphy to be delayed

    Wed 12th Jan 2011 | Legal

The long awaited verdict on the Premier League’s battle against Karen Murphy and the broadcasting of the league’s games using foreign receivers looks likely to be delayed.

It’s understood that the verdict of an influential figure in the European court case on has been delayed until next month,.

According to the Publican, Julianne Kokott, an advocate general at the European Court of Justice, was due to give her opinion on the long-running appeal involving licensee Karen Murphy on Thursday (January 13).

But Kokott will not deliver her opinion now until February 3. The opinion will be handed down in the Grand Chamber of the European Court of Justice, in Luxembourg.

It is unclear why the advocate general’s opinion has been put back.

Once the advocate general has given her opinion, judges at the ECJ are expected to give their verdict within three months.

But this will not be the end of the case, as their judgement will be sent to the UK’s High Court, which will sit again for the case.

The case, which was referred to the ECJ by the UK’s High Court in 2008, is looking at whether the EU law on the free movement of goods should be applied to decoder cards, used by pubs to access Premier League football.

Suppliers of foreign satellite equipment are also involved in the case, after the Premier League previously launched High Court action against them.

Why.....it just means that more and more people will watch it in the pub and the £23m/season (yes 23 million each season) that SAFC recieves from the sale of international rights may be affected. I can't really see any upside to it for the club personally..........can you......or do you not go to the games.

It'll be interesting to see what happens with Sky if she does win.

they seem to be really brazen about showing games at the minute, last year people were ringing around trying to see where had it on yet now our local pubs have signs outside them every week advertising showing the match. Can the police not challenge them while this court case is ongoing or something?
